Debt Review Process

Initial Consultation with a Registered Debt Counsellor

  • Contact a debt counsellor registered with the National Credit Regulator (NCR).
  • Provide financial documents (proof of income, expenses, and a list of debts).

Financial Assessment

  • The counsellor evaluates your financial situation to determine if you are over-indebted (unable to meet debt obligations).

Notification to Creditors and Credit Bureaus

  • The counsellor formally notifies all creditors and credit bureaus of your debt review application.
  • Your credit profile is flagged, restricting new credit applications.

Debt Restructuring Proposal

  • The counsellor negotiates with creditors to reduce monthly payments, potentially by lowering interest rates, extending terms, or consolidating debts.
  • Creditors have 60 business days to object to the proposal.

Application for Court Order

  • If creditors agree (or fail to object), the counsellor applies to a magistrate’s court for a Consent Order or Rehabilitation Order to formalise the repayment plan.
  • The court ensures the plan complies with the NCA and is fair to all parties.

Court Approval and Implementation

  • Once the court approves the plan, it becomes legally binding.
  • You make a single monthly payment to a Payment Distribution Agency (PDA), which disburses funds to creditors.

Ongoing Monitoring

  • The counsellor monitors compliance with the plan and conducts annual reviews.
  • Adjustments may be made if your financial situation changes.

Issuance of Clearance Certificate

  • After all debts are settled, the counsellor issues a Clearance Certificate.
  • Credit bureaus update your record, removing the debt review status.
